These terms of use (the “Terms”) govern your access to and use of the website northnumeric.com (the “Site”), operated by Nord Numérique Inc. (“Nord Numérique,” “we”). By browsing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Description of the Site

The Site presents Nord Numérique’s technology consulting and delivery services, allows you to contact us, view open positions, and submit an application. The Site’s content is provided for informational purposes and does not constitute a contractual commitment prior to the conclusion of a signed agreement between the parties.

2. Intellectual Property

Unless otherwise indicated, all content on the Site (text, graphics, logos, layouts, code, and visual elements) is the property of Nord Numérique or its licensors and is protected by Canadian and international copyright and trademark laws.

You may browse the Site and print excerpts for your personal, non-commercial use. Any reproduction, distribution, modification, or commercial use of the Site’s content without our prior written authorization is prohibited.

3. Acceptable Use

By using the Site, you agree not to:

  • attempt to gain unauthorized access to our systems or those of a third party via the Site;
  • transmit content that is illegal, defamatory, fraudulent, or infringes on the rights of a third party;
  • use an automated means (bot, scraping script) to collect content from the Site without our authorization;
  • submit a form on the Site (contact, application) for purposes other than its intended purpose, notably for spam or unauthorized security testing;

4. Submissions: Contact Form and Applications

By submitting a request through the contact form or a job application, you confirm that the information provided is accurate and consent to us processing it in accordance with our Privacy Policy. You remain responsible for the accuracy of the documents you send us (notably your resume).

We do not guarantee that an application or contact request will receive a response within a specific timeframe, although we make every effort to respond promptly (see the Privacy Policy for indicative timelines).

5. Links to Third-Party Sites

The Site may contain links to sites operated by third parties (e.g., LinkedIn). These links are provided for your convenience only; we exercise no control over these sites and disclaim any responsibility for their content, practices, or privacy policies. Visiting a third-party site is at your own risk.

6. Site Availability

We strive to keep the Site accessible but do not guarantee uninterrupted or error-free availability. We may suspend access to the Site, in whole or in part, notably for maintenance purposes, without notice or liability to you.

7. No Warranty

The Site and its content are provided “as is” and “as available,” without warranty of any kind, express or implied, notably as to their accuracy, completeness, or fitness for a particular purpose, to the extent permitted by applicable law.

8. Limitation of Liability

To the maximum extent permitted by law, Nord Numérique shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from the use or inability to use the Site, even if we have been advised of the possibility of such damages. Nothing in these Terms is intended to exclude or limit any liability that cannot legally be excluded or limited under applicable Quebec or Canadian law (notably in the case of gross or intentional fault).

9. Indemnification

You agree to indemnify and hold Nord Numérique harmless from any claim, loss, or expense (including reasonable legal fees) arising from your use of the Site in violation of these Terms or applicable law.

10. Changes to the Terms

We may modify these Terms at any time; the version in effect is the one published on this page, along with its update date. Your continued use of the Site after a modification constitutes your acceptance of the modified Terms.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of the province of Quebec and the applicable federal laws of Canada, without regard to conflict of law principles. Any dispute arising from these Terms or the use of the Site shall be submitted to the exclusive jurisdiction of the courts of the judicial district of Montreal, Quebec, subject to any rights that a public-order law applicable in your province of residence may otherwise guarantee you before another court.

12. Severability

If a provision of these Terms is found invalid or unenforceable by a court of competent jurisdiction, that provision will be applied to the maximum extent permitted, and the remaining provisions will remain in full force and effect.

13. Language

In accordance with the Charter of the French Language, the French version of these Terms and of the Site prevails. An English version is available for your convenience; in the event of a discrepancy between the two versions, the French version governs.
